Os direitos humanos nos currículos dos cursos de direito de universidades públicas brasileiras: desafios e possibilidades na formação continuada de professores

Resumo
Este trabalho propõe uma reflexão sobre os Direitos Humanos, a Educação em
Direitos Humanos no Brasil e a formação continuada dos professores com foco
na análise das matrizes curriculares de cursos de graduação em Direito de três
universidades públicas brasileiras: UFPR, UFSC e USP. A pesquisa organizouse
pelo levantamento bibliográfico e documental em uma abordagem qualitativa
que buscou a interpretação do fenômeno por meio de um estudo descritivo e
exploratório, considerando, sobretudo, as contribuições de Sacristán (1998;
2000) e Arroyo (2015). A problemática que guiou o desenvolvimento do estudo
indagou em que medida as matrizes curriculares previstas nos cursos de
graduação em Direito possibilitam a abordagem dos Direitos Humanos em
consonância com o Plano Nacional de Educação em Direitos Humanos e as
Diretrizes Nacionais para a Educação em Direitos Humanos? Nessa perspectiva,
teve como objetivo geral analisar as matrizes curriculares dos cursos de Direito
face às orientações normativas das políticas públicas sobre a inserção da
temática dos Direitos Humanos no ensino superior. Os achados apontam que os
currículos dos cursos de Direito analisados possuem disciplinas com temáticas
voltadas aos Direitos Humanos, abrangendo disciplinas obrigatórias e optativas,
sendo que a maior oferta sobre DH está relacionada nas disciplinas optativas.
Entretanto, está praticamente ausente nos currículos oficiais a temática
específica da Educação em Direitos Humanos. Os resultados apresentados
nesse trabalho também apontam que os Direitos Humanos ainda são ensinados
como normas e conceitos, sem um caráter pedagógico voltado para a Educação
em e para Direitos Humanos. Por fim, assinala-se a necessidade de uma
formação continuada de professores voltada à Educação em e para os Direitos
Humanos nos cursos superiores de Direito e, para tanto, propõe-se como
produto dessa pesquisa, por se tratar de um mestrado profissional em Educação
e Novas Tecnologias, a elaboração de um curso na modalidade EAD com o uso
de recursos tecnológicos digitais para formação continuada de professores em
e para Direitos Humanos.
This work proposes a reflection on Human Rights, Human Rights Education in Brazil and the continuing education of professors, focusing on the analysis of the curricular matrices of undergraduate courses in Law at three Brazilian Public Universities: UFPR, UFSC and USP. The research was organized by the bibliographic and documentary survey in a qualitative approach that sought to interpret the phenomenon through a descriptive and exploratory study, especially considering the contributions of Sacristán (1998, 2000) and Arroyo (2015). The problem that guided the development of the study asked to what extent, the curricular matrices foreseen in the undergraduate courses in Law allow the approach of Human Rights in line with the National Plan for Education in Human Rights and the National Guidelines for Education in Human Rights? From this perspective, the general objective was to analyze the curricular matrices of Law courses in the light of the normative guidelines of public policies on the insertion of the theme of Human Rights in higher education. The findings indicate that the curricula of the Law courses analyzed have subjects with themes focused on Human Rights, covering compulsory and optional subjects, with the greatest offer on DH being related to the optional subjects. However, the specific theme of Human Rights Education is practically absent in the official curricula. The results presented in this work also point out that Human Rights are still taught as norms and concepts, without a pedagogical character focused on Education in and for Human Rights. Finally, it is pointed out the need for a continuous education of teachers focused on Education in and for Human Rights in higher law courses and, for that, it is proposed as a product of this research, because it is a professional master's degree in Education and New Technologies, the elaboration of a course in the EAD modality with the use of digital technological resources for the continuous training of teachers in and for Human Rights.
