Sexting e suas consequências penais

Abstract

O presente trabalho apresentará conceitos de sexting e analisará suas consequências penais. Serão abordados crimes envolvendo vítimas maiores e menores de idade, além dos relacionados a invasão de dispositivo informático alheio, violação da intimidade da mulher ou do registro não autorizado contendo cena de nudez, pornografia de vingança e “estupro virtual”. Importante ressaltar que esta prática não é tipificada criminalmente, porém sua divulgação gera efeitos penais. Tratando-se de pessoa maior de idade, tal conduta somente é identificada como crime se a propagação não for consentida. Envolvendo vítima criança ou adolescente, mesmo com sua autorização é caracterizado o delito. Com a crescente difusão de dispositivos informáticos, aliada à inclusão digital, este compartilhamento sexual hoje em dia é bastante utilizado, principalmente por adolescentes e jovens adultos. No entanto, com a disseminação do conteúdo erótico, a exposição deste grupo pode se tornar pública. Este artigo vai se limitar a analisar as novidades do texto normativo e as consequências sancionatórias decorrentes deste tema.

The current work will present the concepts of sexting and analyze its criminal consequences. It will be shown the crimes involving both adults and underage victims, besides those concerning the hacking of third party computer devices, violation of one’s intimacy through the unauthorized register of erotic content, revenge porn and “virtual rape”. It is important to note that the practice of sexting is not a crime by itself, but the disclosure of the material to third party may have criminal consequences. If the victim is and adult it will only be classified as a crime when the perpetrator shares the content without the victim’s consent. On the other hand, if the victim is a minor, there will be a legal offense even with the minor’s consent. The growing access to the Internet, coupled with the availability of computer devices to all, made this behavior, nowadays, very common, mainly among teenagers and young adults. However, with the spreading of this kind of erotic content, the exposure of these groups may become widely public. The scope of this article is to assess the novelties of the legal text, as well as the sanctions derived from this theme.
