Direito internacional público dos direitos humanos: o sistema global e os regionais de proteção e estudo do caso Vladimir Herzog

Abstract

O presente trabalho busca analisar a atual conformação dos Sistemas jurisdicionais Global – Organização das Nações Unidas - e Regionais de Proteção dos Direitos Humanos – Corte Interamericana de Direitos Humanos, Corte Africana de Direitos Humanos e Corte Europeia de Direitos Humanos, identificando qual dos sistemas – global ou regionais – atinge de forma mais efetiva a proteção, promoção e garantia dos direitos do homem. Segundo se pretendeu estudar nesta dissertação, a reestruturação dos países aliados na pós-segunda Guerra Mundial contribuiu para a universalização dos Direitos Humanos, influenciando a criação dos sistemas de proteção e a promulgação da Declaração Universal dos Direitos do Homem. Essa transformação se materializou com a formação de um Sistema Global de proteção no ceio da Organização das Nações Unidas; transformação esta que se estendeu para o plano regional do globo com a criação de Sistemas Regionais de Proteção de Direitos Humanos. A verificação de efetividade dos sistemas global e regionais para o presente trabalho se dá pelo método de estudo se caso, como fora visto no julgamento do Caso Vladimir Herzog e outros vs. Estado brasileiro pela Corte Interamericana de Direitos Humanos. Dessa forma, concluiu-se que a criação dos sistemas regionais de proteção dos Direitos Humanos, para além das suas limitações, possibilitou uma análise mais fiel das necessidades de cada Estado pertencente à sua jurisdição.

The present work seeks to analyze the current shape of the Global - United Nations - and Regional - Human Rights Protection - Inter-American Court of Human Rights, African Court of Human Rights and European Court of Human Rights Jurisdictional Systems, identifying which of the global systems. or regional - most effectively affects the protection, promotion and guarantee of human rights. As it was intended to study in this dissertation, the restructuring of the post-World War II Allied countries contributed to the universalization of Human Rights, influencing the creation of protection systems and the promulgation of the Universal Declaration of Human Rights. This transformation materialized with the formation of a Global Protection System at the United Nations supper; This transformation has extended to the regional plan of the globe with the creation of Regional Human Rights Protection Systems. The effectiveness of the global and regional systems for the present work is verified by the case study method, as seen in the judgment of the case Vladimir Herzog et al. Brazilian State by the Inter-American Court of Human Rights. Thus, it was concluded that the creation of regional human rights protection systems, beyond their limitations, allowed a more accurate analysis of the needs of each state within its jurisdiction.
