dc.description.abstractA presente pesquisa tem por objetivo geral analisar em que medida a crise da representatividade política e o estabelecimento do Estado Constitucional após a Constituição de 1988 contribuíram para uma maior atuação do Poder Judiciário brasileiro em detrimento da atuação dos demais poderes Executivo e Legislativo, em matéria política. Utilizando como metodologia a compilação sistemática da bibliografia especializada na área, pretende averiguar duas hipóteses. A primeira hipótese é a de que a crise da representação política no Brasil proporciona ampliação da atuação do Poder Judiciário em temas políticos historicamente tratados na esfera dos Poderes Legislativo e Executivo. A segunda indica que a ampliação da atuação do Poder Judiciário também contribuiu para enfraquecer ainda mais a crença nas estruturas políticas representativas, do ponto de vista do cidadão, que acredita que sua demanda somente será atendida se a solução for buscada por meio da via judicial e também na perspectiva das instituições representativas, que se favorecem da ampliação da esfera do Judiciário para se eximir de decisões que não sejam populares junto ao seu eleitorado. Para tanto, inicialmente foram analisadas as características da Democracia Constitucional, em que se constatou que a ampliação da atuação do Judiciário é decorrente da constitucionalização da política. A constitucionalização da política pode ser caracterizada pelo movimento de ampliação das matérias tratadas na Constituição e que anteriormente faziam parte somente da política. Ao serem incluídos na Constituição, esses direitos passaram a ser passíveis de proteção judiciária. No entanto, a ampliação do âmbito de atuação do Poder Judiciário não se deve apenas à constitucionalização da política realizada pela Democracia Constitucional, mas se refere também à crise da representatividade política. O Brasil está vivendo um período de profunda crise e descrença em suas instituições representativas, demonstrada inclusive por manifestações populares, como foi o caso das manifestações de junho de 2013. Um dos fatores de agravamento da crise da representação política brasileira é o presidencialismo de coalizão, uma vez que, ao sustentar a capacidade de governo do Executivo na necessidade de apoio e aprovação de suas iniciativas pelo Legislativo, abre margem a negociações fraudulentas e corruptas. Dessa forma, há um incremento nas demandas do Poder Judiciário, devido a descrença nas instâncias políticas, comumente associadas à corrupção. Além disso os próprios políticos provocam a atuação judiciária com o intuito de se eximir de sua responsabilidade política de tomar decisões impopulares junto ao eleitorado e que poderiam comprometer a sua manutenção no poder, bem como a oposição política se utiliza de mecanismos judiciais para dificultar as ações do governo. Por fim, ressalta-se que a atuação judiciária em matéria de política estrita deve ser vista com cautela, pois soluções jurídicas são propostas para problemas do âmbito jurídico e problemas da esfera política devem ser resolvidas por soluções políticas. No momento em que se propõem soluções jurídicas para problemas políticos, corre-se o risco de apenas mascarar a resolução do problema sem resolvê-lo de fato.pt_BR
dc.description.abstractThe present research has as general objective to analyze to what extent the crisis of the political representativity and the establishment of the Constitutional State after the Constitution of 1988 contributed for a greater performance of the Brazilian Judicial Power to the detriment of the performance of the other Executive and Legislative powers in political matter. Using as methodology the systematic compilation of the specialized bibliography in the area, it intends investigate two hypotheses. The first hypothesis is that the crisis of political representation in Brazil provides an extension of the Judiciary's performance in political issues historically treated in the sphere of Legislative and Executive Powers. The second indicates that the expansion of the judiciary also contributed to further weaken the belief in representative political structures, from the point of view of the citizen, who believes that their demand will only be met if the solution is sought through the judicial process and also from the perspective of representative institutions, which favor the expansion of the sphere of the judiciary to escape from decisions that are not popular with its electorate. For that, initially the characteristics of the Constitutional Democracy were analyzed, in which it was verified that the amplification of the Judiciary action is due to the constitutionalization of the policy. The constitutionalization of politicy can be characterized by the movement of expansion of the matters dealt with in the Constitution and that previously were only part of politicy. When they were included in the Constitution, these rights became subject to judicial protection. However, the scope of the judiciary is not only due to the constitutionalization of the policy carried out by Constitutional Democracy, but also refers to the crisis of political representation. Brazil is experiencing a period of deep crisis and disbelief in its representative institutions, demonstrated even by popular demonstrations, as was the case of the demonstrations of June 2013. One of the worsening factors of the crisis of Brazilian political representation is the coalition presidentialism, since by sustaining the Executive's capacity for government to support and approve its initiatives by the Legislative, it opens the door to fraudulent and corrupt negotiations. In this way, there is an increase in the demands of the Judiciary, due to the disbelief in the political instances, commonly associated with corruption. In addition, the politicians themselves provoke legal action to extricate themselves from their political responsibility to make unpopular decisions with the electorate that could jeopardize their maintenance in power, and the political opposition uses judicial mechanisms to hamper actions from the government. Finally, it should be pointed out that judicial action in matters of strict policy must be viewed with caution, since legal solutions are proposed for problems of the legal scope and problems of the political sphere must be solved by political solutions. At the moment when legal solutions are proposed to political problems, there is the risk of only masking the resolution of the problem without actually solving it.en
