As posturas municipais de Curitiba entre 1820-1860: uma análise da regulação dos comportamentos

Abstract

Esta dissertação pretende compreender o sistema jurídico que moldou as posturas municipais de Curitiba durante o século XIX, explorando seus limites constitucionais e legais, além de ver como essas normas podem ter moldado o futuro Direito Administrativo. A pesquisa adota o método indiciário de Carlo Ginzburg para reconstruir um provável passado a partir de pistas incompletas, como as posturas e registros jornalísticos da época. Inspirado na micro-história, o estudo analisa uma realidade particular para compreender aspectos mais amplos do período. A análise se concentra nas normativas que regulavam as interações entre os cidadãos e a administração local, buscando elucidar os conflitos e negociações que permeavam a sociedade curitibana do século XIX. Apesar das limitações decorrentes da falta de algumas fontes primárias, espera-se que este trabalho sirva como ponto de partida para investigações futuras sobre o papel das leis municipais no Brasil imperial.

This dissertation aims to understand the legal system that shaped the municipal ordinances of Curitiba during the 19th century, exploring their constitutional and legal boundaries, as well as examining how these norms may have influenced future Administrative Law. The research adopts Carlo Ginzburg's method of inference to reconstruct a probable past from incomplete clues, such as the ordinances and journalistic records of the time. Inspired by micro-history, the study analyzes a particular reality to comprehend broader aspects of the period. The analysis focuses on the regulations governing interactions between citizens and local administration, seeking to elucidate the conflicts and negotiations that permeated Curitiba's society in the 19th century. Despite limitations due to the lack of some primary sources, it is hoped that this work will serve as a starting point for future investigations into the role of municipal laws in imperial Brazil.
